About eight months after the Attorney-General of the Federation (AGF) directed the Energy Commission of Nigeria (ECN) to pay a judgment debt to two companies—PSC Industries Limited and OGB-Tech Nigeria Limited—the agency has yet to comply.
The debt, initially valued at ₦157 million, has risen to approximately ₦295 million, including accrued interest at a rate of 10% per year since 2018. The dispute began after ECN allegedly failed to pay the firms for solar energy projects executed under contracts awarded for the Jarkum, Agoloma, Obokun, and Batagarawa sites.
The Federal Capital Territory High Court ruled in favour of the companies in 2018, a decision later upheld by the Court of Appeal in 2022 and affirmed by the Supreme Court on June 7, 2024. Justice Habeeb Abiru, delivering the lead judgment, dismissed ECN’s appeal as “unmeritorious.”
Following repeated demands for payment, the firms’ lawyers, led by Prof. Yemi Akinseye-George (SAN), wrote to the AGF in February 2025 seeking consent to garnish ECN’s bank accounts. In March, the AGF’s office advised ECN to settle the debt “amicably and without delay.”
However, both firms allege that ECN has failed to comply, threatening to seek further legal enforcement.
