The Nigerian Bar Association (NBA), Bwari Branch, has directed Vehicle Inspection Office (VIO) operatives to withdraw from Federal Capital Territory (FCT) roads within seven days, citing defiance of a Federal High Court ruling.
The NBA Human Rights Committee, led by Chairperson Anayisi Agnes Fashe-Omuya, raised concern over VIO officers resuming stops, inspections, and fines despite a court order in Suit No. FHC/ABJ/CS/1695/2023 — Marshal Abubakar v. Directorate of Road Traffic Services & 4 Ors. — which barred such activities.
The Committee warned that continued noncompliance would prompt contempt proceedings and the use of all legal avenues to enforce the judgment. It emphasised that ignoring court orders risks undermining the rule of law and public confidence in governance.
Justice Evelyn Maha had ruled that VIOs lack constitutional or statutory authority to stop vehicles, impound them, or levy fines, granting a perpetual injunction against the agency in the FCT.
While Abuja motorists welcomed the judgment, Lagos authorities noted that it does not apply in their state. Lagos Commissioner for Transportation, Oluwaseun Osiyemi, cited the Transport Sector Reform Law of 2018, affirming VIO’s powers to enforce traffic regulations and penalties in Lagos.
